25. Transportation Article Section 21-901.1(b) Negligent Driving: You are instructed that a person is guilty of negligent driving if he drives a motor vehicle in a careless or imprudent manner that endangers any property or the life or person of any individual.

Transportation Article Section 21-801(b) Driver to Control Speed: You are instructed that it is the law of this State that at all times, the driver of a vehicle on a highway shall control the speed of the vehicle as necessary to avoid colliding with any person or any vehicle or other conveyance that, in compliance with legal requirements and the duty all persons to use due care, while on or entering the highway.

 

27. Transportation Article Section 21-707(c) the driver of a vehicle approaching a stop sign at an intersection shall stop at the near side of an intersection and, if there is no crosswalk, at the nearest point before entering the intersection that gives the driver a view of traffic approaching on the intersecting roadway.

 

28. Eastern Contractors, Inc. v. State to Use of Seifert, 225 Md. 112, 169 A.2d 430 (1961), there is no duty to anticipate that a driver facing a stop sign or red light will not obey the statutory obligation to stop and yield the right of way.

 

29. Schwier v. Gray, 277 Md. 631, 357 A.2d 100 (1976); Thompson v. Terry, 245 Md. 480, 226 A.2d 540 (1967). A driver confronted with a stop sign has an absolute duty to stop and an absolute duty to yield the right-of-way to another driver favored and not confronted by a stop sign.
